Sam Russell Photography Terms and Conditions

By booking a slot with Sam Russell Photography, you agree to the following Terms of Service.

 

  1. Creative Liberty

The Photographer shall have creative liberty in producing wedding photography for the Client. The Client acknowledges and accepts the quality of work displayed in the Photographer’s portfolio as the standard they can reasonably expect.

 

  1. Payment

 

The Client agrees to make a non-refundable retainer payment to the Photographer in the amount of $50 for mini-shoots, or 50% of the final payment at least a week before the commencement date of the photoshoot.

Final photos will not be delivered until final payment has been made in completion.

  1. Damages

The Client is solely responsible for financial reimbursement in the event of any damage to property and/or equipment during the shoot that is not consequential of The Photographer.

 

  1. Liability

The Photographer is not liable for accidents that may happen to the Client or people attending on behalf of the Client including dependants and pets, including trips or falls, allergic reactions, reactions to animal bites or stings, or anything of the like.
If the Client brings animals, the animals must be restrained appropriately (eg. leashes for dogs, cages for cats). The Photographer is not responsible for any damages that may occur to animals before, during, or after the photoshoot, for example: animal bites, physical injury, ticks and/or fleas, or catching diseases such as parvovirus.

 

  1. Termination

In the event that the Client or attendees on behalf of the Client makes the Photographer feel uncomfortable or unsafe, the Photographer reserves the right to leave the shoot without notice. In this event, full payment is still required.

In the event of The Photographer cancels the photoshoot or an Act of God prevents the Photographer from attending the photoshoot, a different date will first be attempted, and if an agreement cannot be made, any amount paid will be refunded.

 

  1. Re-Editing

The Client is allowed one free re-edit of images if they are unhappy with the initial work. Any further changes will require a fee.

 

  1. Delivery

The Photographer will deliver the finalized work with high resolution and web resolution images will be delivered via online gallery. Online gallery will be available for 30 days, after which images will be archived. Client is responsible for ensuring photographs are downloaded before that date. Fees for accessing archived photographs may apply.

 

  1. Cancellation Fee

A cancellation fee of the non-refundable deposit applies if the Client cancels the shoot with less than three working days’ notice.

 

  1. Usage Rights

The Client has the rights to use all images as they see fit. The Photographer has the right to use images on social media and their website for portfolio examples. The Photographer retains all copyrights of images taken during shoots, while the Client holds an indefinite license to distribute images as seen fit.
